Situation
The client purchased an apartment in 2019 with a mortgage. After losing his job in 2024, he stopped making payments. The bank initiated ejecución hipotecaria. 2026 context: Euribor 12M ≈ 2.80% — variable mortgage payments have risen significantly compared to 2020–2021.
Solution
Our lawyers initiated negotiations with the bank under the Código de Buenas Prácticas (RDL 6/2012), securing a temporary moratorium. The penalty interest clauses were challenged. The court suspended enforcement proceedings.
Result
The apartment was saved. The bank agreed to restructuring with a 12-month grace period and a reduced rate. Unlawful penalty interest was recalculated.
