The Ukrainian couple with 7+ years in Spain were divorcing. Joint assets: Barcelona apartment and house in Ukraine. Dispute over applicable law and maintenance for two minor children. An error in applicable law risked invalidating the agreement in one country.
Solution
Our lawyers determined the applicable law under EU Regulation 1259/2010 (Rome III) and the Hague Protocol. A mediated agreement was reached: Barcelona apartment to wife, Ukraine to husband. Maintenance set by the Barcelona Family Court. Documentation for recognition in Ukraine prepared.
Result
Divorce finalised without litigation. Children with mother, regular maintenance payments. Agreement enforced in both countries.
