A client who sold a flat in Valencia after moving abroad faced a 3% withholding on the sale price by the buyer (Modelo 211) — the mandatory mechanism to secure the non-resident’s tax payment. We calculated the actual capital gain (19% for all non-residents regardless of country), prepared the Modelo 210 within the three-month deadline following the month after the sale date, and filed for a refund of the difference, since the 3% withheld exceeded the actual tax due. The client received the refund of the excess withheld amount within a few months of filing.
