Client’s Situation
Four months after purchasing a villa: cracks appeared in the load-bearing walls, waterproofing problems were identified, structural defects in the roof were discovered. The seller claimed that he “had no knowledge” of these issues.
Legal Issue
Spanish law allows buyers to claim compensation for hidden defects (vicios ocultos) when: the defect existed prior to the sale, it was not visible or reasonably detectable at the time of purchase, it affects the usability or habitability of the property.
Our Strategy
Appointed an independent technical expert assessment. Established that the defects predated the transaction. Filed a court claim seeking compensation for repair costs.
Result
The court ordered the seller to pay €72,000 in compensation. Legal costs were partially reimbursed.
