Client’s Situation
A property owner in Barcelona contacted us regarding a tenant who: failed to pay rent for five months, accumulated rental debt of €9,500, ignored written payment requests, continued occupying the apartment, stopped responding to communications. The lease agreement had been signed for a five-year term. Additionally: utility contracts remained in the owner’s name, electricity debt had accumulated, neighbours submitted complaints about noise disturbances.
Our Strategy
We sent an official notice to the tenant including the exact amount owed, a deadline for payment, formal warning of legal proceedings. We filed a court claim requesting eviction for non-payment (desahucio), recovery of accumulated debt, payment of future rent until actual surrender of the property, reimbursement of legal costs. One week before the eviction date, the tenant claimed social vulnerability. We demonstrated that the tenant had sufficient income, challenged the vulnerability claim, secured continuation of the eviction procedure.
Result
Court judgment ordering eviction. Forced eviction date confirmed. Full debt awarded. Legal costs imposed on the tenant. Total amount recovered: €14,600. The property was returned to the owner.
