Legal Framework
The transition from temporary protection to ordinary residence is now strictly governed by four key legal instruments:
- RD 1325/2003 — Establishes the obligation to file a renuncia expresa (formal renunciation) of TP status after obtaining the new permit.
- RD 316/2026 — The landmark reform opening access to all residence permits processable within Spain.
- SEM 2/2026 — Instruction ensuring uniform interpretation of the reform across all Spanish regions.
Who Can Apply
The new instruction identifies six primary categories for the transition:
1. Employment (Cuenta Ajena)
Requires an employment contract (min. 30h/week) and payslips (nóminas) for the last 3 months. Labor market restrictions no longer apply to TP holders.
2. Self-employed (Autónomo)
Requires active tax registration (Mod. 036) and evidence of tax filings (Mod. 130/303 or IRPF).
3. Arraigo Sociolaboral
Requires 2 years of residence in Spain. Key fact: time spent under temporary protection now counts toward this period in full.
4. Other Pathways
Includes Digital Nomad status, investors, highly qualified professionals, or social/educational *arraigo* for students.
Accrual & Larga Duración
The most important rule: TP periods and the new residence permit periods are added together to qualify for EU Long-Term Residence (Larga Duración).
- 5 years of continuous legal residence is required.
- Absences: max 6 consecutive months and 10 months total over 5 years.
- Those who arrived in early 2022 have already accrued over 4 years toward this goal.
5-Year Permits for Children
A major advantage for families: while parents may initially receive a 1-year permit, children receive a 5-year card immediately.
- Born in Spain: Simplified processing from birth.
- Not born in Spain: Proving the relationship with the parent holding TP status is sufficient.
Special Profiles
- IT Professionals: Access to Law 14/2013 as qualified professionals or Digital Nomads.
- Retirees: Modification via social *arraigo* or family reunification.
- Seafarers: Employment modification via contract or direct switch to *larga duración*.
Procedure After Decision
- Decision: Received electronically via the SEDIPUALB system.
- Renuncia expresa: Mandatory formal renunciation of TP status at the *Oficina de Extranjería*.
- Fingerprints: Booking the *huella* appointment for the new TIE card.
- Collection: The new TIE card is typically ready in 35–45 days.
